Section 11 Petition Can Be Filed Only After Failure Of Parties To Appoint Arbitrator Within 30 Days Of Notice, Limitation Act Applies: Delhi High Court

The Delhi High Court has clarified that a Section 11 petition under the Arbitration and Conciliation Act can only be filed after the parties fail to appoint an arbitrator within 30 days of notice. Representing the petitioner, Siddharth Bambha argued that the arbitration proceedings were initiated within the limitation period, a position the court upheld.


The court appointed Sandeep Mahapatra as the arbitrator in the case between Information TV Private Limited and Jitendra Dahyabhai Patel, reinforcing that the petition was filed in a timely manner under the Arbitration and Conciliation Act.
